Purpose
These terms govern the use of Noroît, an online marine weather forecasting and routing service for recreational boating, available at www.noroit.org (the “Service”), and the subscription to its paid plans. The Service is provided by INFODUX LLC, 8 The Green, Suite A, Dover, DE 19901, USA (“we”).
Creating an account or subscribing to a plan means you accept these terms. The applicable version is the one in force on the date of subscription or, for the free plan, on the date of use.
The Service
Noroît compares forecasts from several weather models, displays wind, wave, current and pressure maps, and computes routes from your boat’s polar, the forecasts, currents, bathymetry and known hazards. The available features depend on the plan you choose.
A decision aid, not a navigation instrument
Forecasts can be wrong, sometimes badly; computed routes rely on those forecasts and on incomplete depth and hazard data, which do not take today’s tide into account. Noroît does not replace official weather forecasts, official nautical charts, safety equipment or keeping watch. The skipper alone decides whether to sail, which route to follow and how to keep the boat and crew safe.
Account
Some features require an account, created with a valid email address. You agree to provide accurate information, to keep your sign-in credentials confidential and to tell us about any unauthorized use. An account is personal: it may not be shared or transferred.
The Service is intended for adults. A minor may only use it with the consent of their legal guardian, who subscribes to any paid plan.
You can delete your account at any time from “My account” in the application.
Plans and prices
- Discovery: free, with no credit card and no time limit.
- Coastal: €24 per year or €2.90 per month.
- Offshore: €49 per year or €5.90 per month.
What each plan includes (weather models, horizon, number of routings per day, maximum distance, precision features, alerts…) is described on the pricing page and in the application before any subscription. These usage limits are part of the plan.
Prices are stated including all taxes for customers in the European Union. The applicable tax (VAT or equivalent tax) depends on your country of residence; it is calculated and shown before payment.
We may change our prices. Any increase is announced to you by email at least 30 days in advance and only applies from the next renewal; you may cancel before that date at no cost.
Free trial
A free trial period of a paid plan may be offered to you. Its length and conditions are stated before it starts. No payment is requested during the trial; at its end, unless you subscribe, the account automatically returns to the Discovery plan, at no cost.
Ordering and payment
You subscribe in the application. Before paying, a summary shows the plan, the period (month or year), the price, the taxes and the date of the next renewal. The contract is formed when the payment is confirmed; a confirmation email and an invoice are sent to you.
Payments are processed by our provider Stripe. We never have access to card numbers. Your invoices remain available in your customer area.
If a payment fails, Stripe tries again and you are informed. If the payment is not settled within 7 days, the account returns to the Discovery plan; your data is kept.
Term and renewal
The subscription runs for the chosen period (one month or one year) from the payment and renews automatically for the same period, at the price then in force, unless canceled.
For yearly subscriptions, we notify you by email between one and three months before the renewal date, stating the renewal date, its amount and how to cancel.
Cancellation
You can cancel at any time, in a few clicks, from “My account” in the application. Cancellation takes effect at the end of the current period: your plan stays active until then, and the account then returns to the Discovery plan. There is no fee and no notice period. Except in the cases set out in the refund policy, the period already started is not refunded.
We may suspend or close an account in the event of a serious breach of these terms (fraud, circumventing limits, abusive use), after informing you except in an emergency. If we discontinued the Service, we would notify you at least 30 days in advance and refund the unused portion of current subscriptions.
Right of withdrawal
If you are a consumer residing in the European Union, you have 14 days from the subscription to withdraw, without giving any reason. By subscribing, you ask for the Service to start immediately.
We go beyond what the law requires: if you withdraw within this period, we refund the full amount paid, with no deduction for the period already used. To withdraw, email us at contact@noroit.org or use the model form in the refund policy. The refund is made within 14 days, to the payment method used.
Changing plans
Moving to a higher plan takes effect immediately; the amount due is calculated pro rata for the time remaining in the current period. Moving to a lower plan takes effect at the next renewal.
Service availability
We do our best to keep the Service available at all times, without being able to guarantee it: maintenance, outages, or the unavailability of data providers (weather models, bathymetry, mapping) may interrupt it or limit some of its features. The data shown is what these providers publish, with their delays and gaps.
An interruption caused by us lasting more than 72 consecutive hours entitles you, on request, to a refund or a credit for the corresponding period (see the refund policy).
Acceptable use
You agree not to:
- extract data in bulk or query the Service in an automated way;
- circumvent the limits of your plan, in particular by creating multiple accounts;
- resell, redistribute or make the Service or its results available to third parties for commercial purposes;
- harm the security or operation of the Service.
Liability
Since Noroît is a decision aid (section 2), we are not liable for navigation decisions made based on the Service, nor for damage resulting from an incorrect forecast, incomplete data or an interruption of the Service.
To the extent permitted by law, our liability in connection with the Service is limited to direct and foreseeable damage, and capped at the amount you paid us during the twelve months preceding the event giving rise to the claim.
These limits do not apply where the law prohibits them, in particular in the event of gross negligence or willful misconduct on our part, and do not deprive consumers of the rights granted to them by the mandatory provisions of their country of residence.
Ownership and content
The Service, its software and its content belong to INFODUX LLC, subject to the third-party open data listed in the legal notice. The subscription gives you a personal, non-exclusive and non-transferable right of use for the duration of the plan.
The information you enter (boats, polars, waypoints, alerts, settings) remains yours. You authorize us to store and process it solely to provide you with the Service.
Personal data
The processing of your personal data is described in the privacy policy.
Changes to these terms
We may change these terms, for example to reflect changes in the Service or in the law. Any significant change is announced to you by email at least 30 days before it takes effect; if you do not accept it, you may cancel at no cost before that date.
Governing law and disputes
These terms are governed by the laws of the State of Delaware (USA). If you are a consumer, you keep the protection of the mandatory provisions of the law of your country of residence and may bring proceedings before the courts of your place of residence.
If there is a problem, please email us first at contact@noroit.org: we reply within 7 business days and work with you toward an amicable solution.
